About the Course: This course covers international humanitarian law as applied to soldiers, humanitarian workers, refugees, displaced persons, and others involved with armed conflict. Topics include background and definitions, protection of victims, rights of prisoners of war, rules of conduct in hostilities, means of implementation, human rights and IHL, the applicability of IHL to peacekeeping and peace enforcement, different applications to international and intra-national conflicts, terrorism, sovereignty, and the role of the International Red Cross in International Humanitarian Law. Written at a higher level than other Peace Operations Training Institute courses, this course deals with complex legal and military issues. Eight lessons.

About the Author: A Swiss national, Mr. Antoine Bouvier studied law and international relations at the University of Geneva and the Graduate Institute of International and Development Studies (now called the Graduate Institute, or IHEID). He joined the International Committee of the Red Cross (ICRC) Legal Division as a legal adviser in 1984. From 1993 to 1994 he served as head of the ICRC Mission in Malawi. After two years as deputy head of the ICRC Division for Policy and Cooperation within the Movement, he was appointed as a delegate to Academic Circles. In this capacity, he has conducted a large number of training sessions in all parts of the world. In 2009, Mr. Bouvier joined the ICRC Advisory Service on International Humanitarian Law. He is the author of several articles on international humanitarian law and its dissemination and the co-author of How Does Law Protect in War?, a collection of cases, documents, and teaching materials on contemporary practice in international humanitarian law, from which several parts of this course have been adapted. Mr. Bouvier retired from the ICRC in 2016 and now works as a consultant.

Sobre el curso: El presente curso trata sobre el derecho internacional humanitario (DIH) y su aplicación a los soldados, trabajadores humanitarios, refugiados, personas desplazadas y demás actores involucrados en el conflicto armado. La temática comprende antecedentes y definiciones, protección de las víctimas, derechos de los prisioneros, reglas de conducta en las hostilidades, mecanismos de implementación, derechos humanos y DIH, aplicabilidad del DIH al mantenimiento de la paz y a la imposición de la paz, diversas formas de aplicación a conflictos internacionales e intranacionales, al terrorismo y a la soberanía, y rol de la Cruz Roja Internacional en el derecho internacional humanitario. Esta nueva edición del curso se basa en las de 2000 y de 2012, e incluye además un análisis de avances recientes en materia de derecho internacional humanitario, tales como el Tratado sobre la Prohibición de las Armas Nucleares. En el presente curso, que se ha elaborado a un nivel más alto que otros cursos del Instituto de Formación en Operaciones de paz, se tratan complejos temas jurídicos y militares.

Sobre el autor: El Prof. Antoine A. Bouvier es ex Asesor Jurídico del Comité Internacional de la Cruz Roja. El Prof. Bouvier, de nacionalidad suiza, cursó sus estudios de Derecho y Relaciones Internacionales en la Universidad de Ginebra y en el Instituto de Altos Estudios Internacionales y del Desarrollo (actualmente llamado “Graduate Institute Geneva” o IHEID). En 1984 ingresó a la División Jurídica del Comité Internacional de la Cruz Roja (CICR) como asesor jurídico. De 1993 a 1994 dirigió la Misión del CICR en Malawi. Tras actuar dos años como subdirector de la División de políticas y cooperación dentro del Movimiento, fue designado delegado del CICR ante los Círculos Académicos. En tal carácter, ha tenido a su cargo numerosas instancias de capacitación en todas partes del mundo. En 2009, el Prof. Bouvier se integró al Servicio de Asesoramiento en Derecho Internacional Humanitario del CICR. Es autor de varios artículos sobre Derecho Internacional Humanitario y su divulgación, y coautor de How Does Law Protect in War? (¿Cómo protege la ley en la guerra?), recopilación de casos, documentos y material didáctico sobre el ejercicio contemporáneo del Derecho Internacional Humanitario, de la cual se han obtenido y adaptado varios tramos del presente curso.

El Prof. Bouvier se retiró de la actividad en el CICR en 2016, y actualmente trabaja como consultor.

Les différentes sections portent sur le contexte et les définitions, la protection des victimes, les droits des prisonniers de guerre, les règles de conduite des hostilités, les moyens de mise en œuvre, les droits de l’homme et le DIH, l’application du DIH dans le cadre du maintien et de l’imposition de la paix, les différentes applications dans le cadre des conflits internationaux et intra nationaux, le terrorisme, la souveraineté et le rôle de la Croix-Rouge internationale dans le droit international humanitaire. Cette nouvelle édition est basée sur les éditions de 2000 et de 2012 et comprend une discussion relative aux évolutions récentes dans le domaine du droit international humanitaire, telles que le Traité sur l’interdiction des armes nucléaires. D’un niveau supérieur que d’autres cours de l’Institut de formation aux opérations de paix, ce cours traite de questions juridiques et militaires complexes.

À propos de l’auteur : M. Antoine A. Bouvier a été conseiller juridique auprès du Comité international de la Croix Rouge. De nationalité suisse, M. Bouvier a étudié le droit et les relations internationales à l’Université de Genève ainsi qu’à l’Institut de hautes études internationales et du développement (IHEID). Il a rejoint la Division juridique du Comité international de la Croix Rouge (CICR) en tant que conseiller juridique en 1984. De 1993 à 1994, il a servi en tant que chef de la mission du CICR au Malawi. Après deux années passées au poste de chef adjoint de la Division doctrine et coopération au sein du mouvement, il a été nommé en tant que délégué auprès des cercles académiques. A ce titre, il a dispensé un grand nombre de sessions de formation à travers le monde. En 2009, M. Bouvier a rejoint le service consultatif sur le droit international humanitaire du CICR. Il a publié de nombreux articles sur le droit international humanitaire et sa diffusion et a co-rédigé l’ouvrage Un droit dans la guerre ?, un recueil d’études de cas, de documents et de matériel pédagogique sur la pratique contemporaine relative au droit international humanitaire, à partir duquel diverses parties de ce cours ont été adaptées. Il a pris sa retraite du CICR en 2016 et travaille actuellement comme consultant.
