Lesson 3 applies a similar analysis to the ICESCR, further distinguishing economic, social, and cultural rights from civil and political rights, and identifying the articles within the covenant that protect them. The lesson will help you understand the state’s obligations to respect, protect, and fulfil these rights as specified in the treaty, as well as the instruments on the state and international levels that are relevant to their legal protection. The lesson includes a discussion on the relative underdevelopment of economic, social, and cultural rights, an issue that ultimately leads to the controversy and difficulty in their enforcement. Excerpts from the ICESCR are provided at the end of the lesson.
